Services

Service Descriptions

JBS Land Management provides land management services including forestry mulching, land clearing, and excavation services in Brooksville, Florida, and surrounding areas in Central Florida. Service descriptions on our website are provided for informational purposes and may not reflect all details or limitations of specific services.

Estimates and Quotes

Estimates provided through our website, by phone, or during property assessments are approximations based on the information available at the time. Final pricing may vary based on actual site conditions, scope changes, unforeseen circumstances, or additional services requested. All estimates are valid for 30 days unless otherwise stated.

An estimate or quote does not constitute a binding contract until both parties have signed a formal service agreement or work order.

Service Agreements

All services are subject to a written agreement or work order that outlines the scope of work, pricing, timeline, and terms specific to your project. By signing a service agreement, you agree to the terms outlined in that document, which will take precedence over these general Terms in the event of any conflict.

Payment Terms

Payment terms will be specified in your service agreement. Generally, we may require a deposit before work begins, with the balance due upon completion. Acceptable forms of payment will be outlined in your agreement. Failure to make payments when due may result in suspension of work, additional fees, or legal action to collect amounts owed.

Cancellations and Rescheduling

If you need to cancel or reschedule a scheduled service, please contact us as soon as possible. Cancellation policies, including any applicable fees, will be outlined in your service agreement. We understand that circumstances change and will work with you reasonably, but last-minute cancellations may result in charges for mobilization costs or lost scheduling opportunities.

Liability and Disclaimers

Limitation of Liability

To the fullest extent permitted by law, JBS Land Management, its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from services rendered shall not exceed the amount paid by you for the specific service giving rise to the claim.

Property Access and Responsibility

By contracting our services, you represent that you have the legal right to authorize work on the property in question. You are responsible for clearly marking any property boundaries, underground utilities, septic systems, wells, irrigation lines, or other features that may be affected by our work. You must notify us of any known hazards or special conditions on the property.

We will make reasonable efforts to locate marked utilities and avoid damage, but we are not responsible for damage to unmarked or improperly marked utilities, structures, or property features. You agree to contact your local utility notification service (such as 811) before work begins if required by law.

Site Conditions

Land management and excavation work is dependent on site conditions including soil type, weather, terrain, and vegetation. While we will make every effort to complete work as agreed, we cannot guarantee specific outcomes if site conditions differ from what was assessed or if unforeseen obstacles are encountered. We will communicate with you about any significant variations and work with you to find appropriate solutions.

Weather and Delays

Outdoor land management work is subject to weather conditions and may be delayed due to rain, flooding, extreme heat, or other environmental factors beyond our control. We are not liable for delays caused by weather, acts of nature, or other circumstances outside our reasonable control.

Permits and Regulations

Unless specifically stated in your service agreement, you are responsible for obtaining any necessary permits, approvals, or clearances required for work on your property. We will work within the scope of services outlined in our agreement, but compliance with local ordinances, zoning regulations, environmental rules, and permit requirements is ultimately the property owner’s responsibility.

Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific results from our services, as outcomes depend on many factors including site conditions and property characteristics.

Indemnification

You agree to indemnify, defend, and hold harmless JBS Land Management, its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of our website or services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any inaccurate or incomplete information you provide
  • Unauthorized property access or work authorization

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Hernando County, Florida.

Informal Resolution

If a dispute arises, we encourage you to contact us first to attempt to resolve the matter informally. Many concerns can be addressed through open communication.

Arbitration

If informal resolution is unsuccessful, any dispute or claim arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Hernando County, Florida. Each party shall bear its own costs of arbitration unless otherwise awarded by the arbitrator.

You agree to waive any right to a jury trial or to participate in a class action lawsuit related to these Terms or our services.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreement, constitute the entire agreement between you and JBS Land Management regarding use of our website and services. These Terms supersede any prior agreements or understandings, whether written or oral, except where a signed service agreement contains specific provisions that differ from these general Terms.
